At least one party must be a citizen of India — this is the foundation of foreign marriage proceedings in India. Marriages solemnized under this framework require that one party is Indian or the other party is a foreigner. The parties may both be Indian but solemnizing their marriage outside India, or one party may be a Non-Resident Indian (NRI). The Marriage certificate is issued after completion of 30 days, under Special Marriage Act.
The Marriage certificate issued is recognised internationally across respective Embassies.
Documents Required
- Passport size photographs — four each of marrying persons
- Residential proof (Voter Card / Passport / Ration Card / Driving License / Bank Passbook / Lease Deed / Rent Deed) of marrying persons
- Date of birth proof (Municipal Corporation Certificate, Xth or XIIth Examination Certificate, Passport, PAN Card) of marrying persons
- If any party is divorcee — certified copy of Decree of Divorce granted by the Court
- If any party is widow/widower — Death Certificate of the deceased spouse
- If any party is a foreign citizen or holds a foreign passport or has foreign residential address — Certificate of Present Marital Status / No Impediment Certificate / NOC from concerned Embassy and valid VISA
- Three witnesses (both must be major) – with Aadhar and PAN Card of Delhi
